Local governments must use QBS to award design contracts for water projects receiving State Revolving Fund grants

Local governments must use Qualifications-Based Selection in awarding contracts for the design of water projects financed through Ohio's Clean Water State Revolving Fund, thanks to the lobbying efforts of the national ACEC.

The Water Resources Reform & Development Act (WRRDA) passed by Congress earlier this year includes a provision long sought by ACEC that requires state governments to ensure that engineering contracts for the design of water projects funded by state revolving funds are awarded in accordance with the Federal Brooks Act or an equivalent state QBS process.

This requirement overrides local contracting policies or ordinances that conflict with QBS.

Following enactment of WRRDA, ACEC's national government affairs staff worked with the U.S. Environmental Protection Agency to develop guidance for applying the new QBS requirement.  This guidance applies to projects funded on or after October 1 of this year.
