5th District Court of Appeals Ruling Affirms Government Immunity for Fire Departments

The 5th District Court of Appeals released a ruling that affirms government immunity for fire departments and townships, in connection with an accident in which a volunteer firefighter (Joe Tadijanac) lost both legs at a mutual aid scene in Richland County, after one tanker rolled forward into another, pinning him.

The appeals court ruling dismissed as a defendant the volunteer who drove the tanker that rolled forward. The 5th District panel concluded he may have been negligent, but was not involved in wanton misconduct.
