New PBM complaint form launched by Ohio Department of Insurance for pharmacies

After months of the new maximum allowable cost (MAC) transparency law being in effect, OPA has heard from many pharmacies asking for a smoother way to submit complaints against a PBM to the Ohio Department of Insurance (ODI).

We're pleased to report to our members that after months of working with ODI on simplifying and streamlining that process, ODI has launched a special portal for pharmacies to utilize to submit complaints.

Here is the newly launched Ohio Department of Insurance PBM Complaint Form:  https://gateway.insurance.ohio.gov/UI/ODI.CS.Public.UI/PBMComplaint/DisplayComplaintForm

As a reminder, OPA has created a guide for member pharmacies to utilize if they feel they have a PBM that is in violation of the new laws. Please follow the guidelines we've created. For those guidelines, as well as an overview of your new MAC rights as a pharmacy, please click here.

OPA would like to thank Lieutenant Governor Mary Taylor, as well as her staff at ODI, who have been extremely helpful during this rollout, and we look forward to the Department reining in any possible bad actors within the PBM industry. Ohio's pharmacies must be protected.

Additionally, we would like to thank Speaker of the House Cliff Rosenberger, Senator Dave Burke, Representative Tim Brown, Representative Jack Cera, and Representative Ryan Smith for continuing to work on this issue even after the legislature passed the PBM reforms and the governor signed them into law. Several legislators have engaged us on this issue since the laws were enacted, but it is important that if you haven't communicated any problems you may be having to your elected officials, you should do so ASAP.

As a reminder, for a complete rundown of the new laws, and what you need to do if you have a PBM that may be in violation of those laws, please bookmark this page.
