DC Fined $2000 for Telephone Solicitation

| | The Ohio State Chiropractic Board of Examiners suspended from practice and fined a Columbus area chiropractor on April 17, 2008, for improper telephone solicitation.
In the call, which was recorded by the consumer, the agent for the doctor was alleged to have failed to adhere to the submitted script, creating the impression that he was calling on behalf of the Columbus Police Department, providing legal services, failing to identify that he was calling on behalf of a chiropractor, offering free services without an appropriate disclaimer and misidentifying the chiropractic clinic. The doctor admitted to four of those six allegations.
"We view this as very a positive step," said Ohio State Chiropractic Association (OSCA) Executive Director Woody Woodward. "This activity is hurting the profession in Ohio and around the country. Our state board deserves credit for stepping up and beginning to send the message that improper solicitation will not be tolerated."
The OSCA Board of Directors unanimously passed a resolution last November strongly discouraging the practice of telephone or in-person solicitation. The association also strongly supported Senate Bill 40 in 2005-2006 which would have banned the practice within 30 days of an accident.
The doctor, who is not an OSCA member, was suspended from practice for 15 days and fined $2000. |
