Take Action Today! Tell Congress to Protect and Expand Affordable Housing Programs. Congress is currently determining fiscal year (FY) 2026 appropriations levels for the Department of Housing and Urban Development’s (HUD) programs. This is our chance to fight for strong investment in American communities–including in proven solutions to address the housing crisis among older adults. HUD’s affordable senior housing programs are effective, and they need to be protected and expanded. Easily reach your lawmakers directly through LeadingAge’s new action alert.
HUD Delays HOTMA to 2027 for Multifamily Housing. HUD has officially delayed compliance with new rules under the Housing Opportunity Through Modernization Act (HOTMA) until January 1, 2027, for affordable housing properties subsidized through HUD’s Multifamily Housing programs. HOTMA is a major rule change for affordable housing providers that adjusts who is eligible for federally-subsidized housing, how much rent they pay, and how rent amounts are calculated by the housing provider. The agency had previously required compliance by January 1, 2026. The new compliance date allows the agency to complete implementation tools for HOTMA compliance, including new housing forms and new rent software used by federally-assisted housing communities. LeadingAge will continue working with housing providers to prepare for HOTMA compliance; in the meantime, housing providers should continue to follow their pre-HOTMA property policies, including their pre-HOTMA tenant selection plans, which do not restrict occupancy based on assets. Read HUD’s memo here. Keep up with LeadingAge’s HOTMA updates here.
House Moves Forward on Affordable Housing Reforms. LeadingAge will stay informed on the deliberation between the House and Senate and will continue to advocate for policies that advance affordable housing for older adults.
LeadingAge Urges DHS to Maintain "Public Charge" Guardrails. In December 19 comments to the Department of Homeland Security (DHS), LeadingAge urged the administration to reverse course on a proposed broadening of “public charge” discretion. Public charge determinations are used by immigration officials to deny legal status to foreign-born people based on expected or actual utilization of government assistance. In November, the agency published a notice of proposed rulemaking, which would rescind the government’s previous policy limiting the scope of public charge grounds for inadmissability for immigrants. Under the proposed rulemaking, immigration officials would instead have broad discretion to deny lawful permanent resident status to a foreign-born person, including older adults and the people who serve them, based on the utilization of government assistance programs. These programs could include housing, nutrition, and healthcare assistance. In its comments, LeadingAge stated, “On behalf of older adults and the workforce that serves them, LeadingAge strongly opposes broad public charge discretion. Public charge policies harm both the aging services workforce and foreign-born older adults by creating fear, limiting access to safety net programs, and making it harder for immigrant caregivers to get legal status. We urge DHS to support, rather than 3 restrict, immigrant access to benefits, as well as pathways to citizenship for the aging services workforce.” LeadingAge urged the administration to maintain current public charge policies and emphasize dignity and access to services.
