Take Action: Urge Your Senators to Protect Older Adults' Housing Assistance. Congress is drafting funding bills for the U.S. Department of Housing and Urban Development (HUD) for fiscal year 2027. Take action now to support a strong Senate HUD funding bill and reject funding reductions proposed by the House. The House has advanced harmful cuts to rental assistance and housing supply programs at HUD—but the Senate can still take action to save and expand housing assistance for the next fiscal year! Act now to urge your Senators to make strong and smart investments in programs our communities rely on. You can personalize your messages to Congress with stories of how HUD funding directly supports residents and affordable housing communities.
Senators Introduce Older Adult Home Modification Tax Credit Bill. On August 3, LeadingAge supported the introduction of the "Senior Accessible Housing Tax Credit Act of 2026" by Sens. Angela Alsobrooks (D-MD) and Kirsten Gillibrand (D-NY). Similar to LeadingAge-supported legislation introduced by Congressman George Latimer (D-NY), the bill would create a new, non-refundable tax credit for older adult homeowners or renters to make age-friendly home modifications to their homes. The tax credit would apply to expenses made by taxpayers aged 60 or older to modify their principal or secondary residence to age in place, with a limit of $10,000 annually. Qualifying expenses include labor costs and materials related to the installation of wheelchair ramps and handrails, doorway widening, installing tub cuts or shower seats, and more. In a statement of support, Katie Smith Sloan, president and CEO of LeadingAge, said: "The opportunity to age in community is critical for America’s older adults to thrive. But too many are not able to do so because of housing that cannot accommodate their needs. Less than five percent of the nation’s homes are accessible to households with even moderate mobility limitations at a time when, due to our country’s rapidly aging population, America desperately needs more age-friendly housing. LeadingAge applauds Senators Alsobrooks and Gillibrand, along with Congressman Latimer, for recognizing this. As the trusted voice for aging, LeadingAge supports the Senior Accessible Housing Tax Credit, which is an important step toward ensuring older adults can make the home modifications they need to live independently for longer."
Proposed Rule Rolls Back Community Reinvestment Act Obligations. Of great concern to LeadingAge and others interested in expanding and preserving the nation’s supply of affordable housing, the Department of Treasury, Office of the Comptroller of the Currency (OCC) and the Federal Deposit Insurance Corporation (FDIC) posted a joint rulemaking on July 31, 2026, amending the regulations implementing the Community Reinvestment Act (CRA) that could weaken investment in affordable housing and community development. The CRA was enacted in 1977 and requires federal banking regulators to encourage financial institutions to help meet the credit needs of the communities in which they do business, including in low and moderate income (LMI) neighborhoods. In particular, a financial institution’s record of meeting the credit needs of its entire community is taken into account by federal regulators when evaluating the financial institution’s application for a deposit facility. Among the changes that the rule proposes for evaluating whether a financial institution is meeting its CRA requirements are: restricting the large bank service test to a bank’s “credit services” – i.e., lending – rather than deposit services; imposing a 15% cap on indirect costs that recipients of community development grants at large banks may incur; recalibrating asset thresholds for small, immediate, and large banks; and tailoring retail lending tests to focus only on a bank’s major product line(s). In particular, the recalibration of asset thresholds would likely reduce the number of banks incentivized to make loans and investments in affordable housing and community development, such as investing in the Low Income Housing Tax Credit (LIHTC). LeadingAge is concerned that this rule would further limit opportunities for affordable housing for older adults, and we will continue to work with our housing partners to coordinate a response in opposing this rule. While this rule has yet to be published in the Federal Register, there will be a 60 day comment period from the date of publication.

LeadingAge Submits Comments on Medicaid Work Requirements Rule. On July 31, LeadingAge submitted comments on the Centers for Medicare and Medicaid Services (CMS) Rule: Medicaid Program; Community Engagement Requirement for Certain Individuals. Our comments highlighted the unique needs and conditions of older adults, including those in affordable housing, by urging categorical exemptions for individuals that have elected hospice or palliative care, more flexibility in the medical frailty exemption, and increased state flexibility in implementing the rule. The rule was released as an interim final rule with comment. The rule is effective July 31, as it was written, though CMS has indicated they may make changes. Our comments can be found here.
CMS Issues Tool for States on Changes to Non-Citizen Medicaid Eligibility. On July 31, the Centers for Medicare and Medicaid Services (CMS) released a tool for states to support their efforts in implementing section 71109 of HR 1. This section changed eligible classes of non-citizens that can qualify for Medicaid, terminating eligibility for refugees, asylees, and humanitarian parolees, among others. Beginning on October 1, only citizens, lawfully permanent residents, Cuban-Haitina entrants, and Compact of Free Association (COFA) Migrants will be eligible for Medicaid. Similar eligibility changes are coming to Medicare on January 1, 2027 from section 71201 of HR 1. The tool from CMS provides operational guidance to states and reiterates the need for states to maintain accurate enrollment records. The tool is available here. We will provide more analysis if necessary, upon further review.
Resources for Residents Who Want to Advocate for Their Caregivers. As immigration policy continues to shift—including recent developments affecting Temporary Protected Status (TPS) for Haiti and other countries—LeadingAge has heard from a growing number of member communities whose residents are asking how they can advocate for the caregivers they value and rely upon every day. Many residents have expressed concern about the uncertainty facing foreign-born members of the aging services workforce and are looking for constructive ways to make their voices heard. We encourage members to use LeadingAge's resident advocacy materials, which were developed to help residents share their experiences and support policies that promote workforce stability. The toolkit includes background information, sample messages, advocacy tips, and other resources residents can use to communicate with their elected officials about the importance of maintaining a stable caregiving workforce. Members may also wish to direct interested residents to the Care for Seniors, Care for America campaign, a coalition effort focused on elevating the voices of older adults, caregivers, providers, and families in support of policies that strengthen the care workforce. LeadingAge is a participant in this effort, which highlights the connection between workforce stability and access to quality care for older adults. At a time when many residents are asking how they can help, these resources provide practical ways to engage and ensure that policymakers hear directly from the people most affected by workforce challenges in aging services.
