I was recently asked a question regarding telemedicine. The question was did you have telemedicine visit with patients residing outside of NYS? With regard to this question I was asked if NYS required the doctor to have a license in the state where the patients resided. Pease advise.
At this time, New York State providers would not be able to perform Telehealth services to patients in neighboring states. However, there is legislation introduced by the state legislature that would allow any eligible provider to do so in the future when the appropriate laws are passed. When that time comes, providers would need to contact the Interstate Medical Licensing Board to apply for supplemental licensure to practice telemedicine in other states. At this time, the only state sharing a border with New York that has legislation enacted that would allow telemedicine services to be provided is Vermont. New Jersey and Massachusetts, like New York, have legislation that has been proposed by their respective state legislatures for debate, but nothing has passed. Connecticut does not have any legislation at this time regarding telemedicine licensure from bordering states, and Pennsylvania has passed legislation, but its implementation has not been finalized at this time.
