Avoiding Lawsuits by Properly Disclosing Vehicle History

Dealers are aware of the legal hazards associated with selling a used motor vehicle. Vehicle history has become one of the most important components of the sale of a used car or truck, and vehicle history has now become the first issue plaintiff attorneys examine when evaluating the merits of a consumer's potential legal action against a dealership. Whether the car or truck you sell has previous damage, a previously branded title, previous mechanical issues, or has a rental history, documentation of the proper disclosure is vital to avoid unnecessary legal claims. Ask yourself the following questions:

(1) Is your dealership properly handling the vehicle history of the car or truck you sell?

(2) Does your sales and F&I staff know what information should be disclosed to a consumer?

(3) Do you properly present (and document) a vehicle history report to your customers?

The OADA AUTOCAP program has experienced an increase in complaints filed by consumers who discover (often when they attempt to trade-in their vehicle to a dealer) that the currently available vehicle history demonstrates that there was damage to the vehicle when the consumer initially purchased the vehicle. That consumer then initiates a complaint against the dealer from whom the consumer purchased the vehicle.
