Reminder: US EPA Updated Underground Storage Tanks Regulations Effective 10/13/2018

In July 2015, the U.S. Environmental Protection Agency updated underground storage tank (UST) regulations, phasing them in over three years.  The state of Ohio's Bureau of Underground Storage Tank Regulation (BUSTR) has adopted these changes.  By October 13, 2018, if your dealership has USTs in Ohio, you will need to ensure compliance with the following: 

1. Annual Release Detection Testing: Owners and operators must test the electronic and mechanical components of their release detection equipment by one of the following methods:
   1. Manufacturer’s instructions
   2. An accepted code of practice
   3. Requirements developed by the implementing agency (BUSTR)
2. Have a qualified individual inspect or test the following systems every 3 years and keep those testing records for at least 3 years.
   1. Tri-annual Overfill Prevention Equipment
   2. Tri-annual Spill Prevention Equipment — Testing must be completed every 3 years unless the spill bucket is double-walled and the integrity of both walls is monitored.
   3. Containment Sump (if applicable) — Owners and operators must test all containment sumps used for piping interstitial monitoring every 3 years unless the containment sump is double-walled and its integrity is monitored.
3. Operation and Maintenance Walkthrough Inspections: Owners and operators will need to complete both 30-day and annual inspections on their UST systems.
   1. 30-Day: Owners and operators will need to visually inspect spill prevention equipment and interstitial monitoring areas for any damages or obstructions and document those findings. Release detection equipment should also be visually inspected to ensure it operates properly. This is also an ideal time to review your release detection records to ensure they are current.
