Fine: ADA Demand Letters New Source of Trolling

Predatory plaintiff’s attorneys have found a new source of legal exploitation in the Americans with Disabilities Act, ICBA President and CEO Cam Fine wrote. In a new Finer Points blog post, Fine noted that a growing number of community bankers have received aggressive letters alleging that their websites do not comply with the ADA.

These demand letters errantly claim that the Justice Department is using existing international guidelines as a baseline requirement for website accessibility. However, the DOJ hasn’t confirmed that these guidelines are in use and isn’t planning to finalize its own set of standards until 2018.

ICBA has called on the Justice Department to intervene by issuing interim guidelines. Meanwhile, it recently released guidelines to help ICBA members respond. Read Fine’s Blog Post.
