ODM shares plans for HB169 repayment

LeadingAge Ohio met with the Ohio Department of Medicaid (ODM) this week to discuss their plans to meet requirements contained in HB169 related to nursing facilities that sell beds or facilities, triggering a legislative requirement to repay the relief funds awarded via HB169. According to HB 169, “(D) Any nursing facility that receives funds under this section that sells any of its business or bed licenses on or before June 30, 2023, shall reimburse the state, from the proceeds of the sale, the funds distributed under this section.”

While the emergency rule has not yet been filed, ODM anticipates only applying the repayment requirement for those facilities who enter into a purchase agreement after disbursements were made on March 29, 2022. Furthermore, the repayment requirement only applies to sales of beds or changes of ownership, and not to those facilities that have relinquished beds to the state during that time. The repayment will equal the greater of the purchase price of beds or the entirety of the relief payment.
