Oral Chemo Fairness Heading to the Governor

On October 12, 2023, after 15 years of championing this effort for our patients, the final legislative vote to ensure that all Michiganders have oral chemo fairness was taken. The bill now heads to the Governor for her signature to become law! Specifically, the bill prohibits a health insurance policy from applying financial requirements to orally administered anticancer medications that are more restrictive than the financial requirements it applies to intravenously administered or injected anticancer medications. The bill limits the out-of-pocket costs for patients to $250 per 30-day supply. Michigan’s Department of Insurance and Financial Services will adjust this out-of-pocket amount annually to reflect the prescription drug index of the medical care component of the U.S. consumer price index.

This will go into effect for underwritten health insurance plans (this does not apply to ERISA exempt plans) in Michigan after December 31, 2025. MSHO anticipates the bill will be signed by the Governor sometime in November.
