Procedure Question

Here is my situation: Rent is due on the 1st of the month, late fees are added on the 6th and we overlock on the 6th as well. Tenants are required to give us a notice of move out 5 days prior to the end of the rental month as per the ncssa lease. I have people that are moving out between the 1st and the 6th with a balance on the account. Technically rent was due on the first and they are leaving their lock on until 2-3 days after the first and then moving out before the overlock or late fees are added. Can I legally (and should I) overlock the unit on the 2nd to prevent this from happening?

Good Morning John,

I don't know that you can over lock the unit physically if it's before the 6th. That's what your lease says. One solution is you can change your lease. My suggestion would be to change your policy on when your gate locks out.Let me be clear the GATE NOT the unit. We do the same as you except we lock out of the gate day 3 past due. This seems to help. They can still tailgate in etc but most will come in and pay. Might be a suggestion for you that would work.
