Auction Process

I'm new to the Auction Process so bear with me. Do I physically have to go to the County Clerk of Courts to file a lien on a past due tenant and if so what do I bring? Also, if I do a UCC search and find a previous lien on tenant, how does that affect the auction process?

If you have Sitelink or a comparable program, you can print all lien information from the individual account. The UCC search only affects the auction if the program gets a hit and it's something like, "Value City Furniture' and you know that there is furniture in there. You send a cert letter to the address stated and they'll let you know if they want to get the furniture (or whatever) and then you have to let them have access for the exact items that they have paperwork for. (sometime company says, Nah, never mind-then you're good to go)THEN you can go to auction. Make sure you leave plenty of time b/c it can affect auction timeline.

UCC turned up a lien notice on our tenant. Lien was filed 2 years prior to the tenant putting items in the unit. We are not even sure the items in the unit are related to this lien. The lien states the secured party is a representative. We have reached out to the representative party but they will only talk with the debtor. How do we find out who is the actual secured party in order to even ask if they want their items back? We feel trapped because we don't know the next step.
