Nursing License and a DUI

This presentation will provide an overview of the administrative process that governs the regulation and discipline of licensees in the State of Ohio. It will also look at provisions of the Ohio Nurse Practice Act and attendant regulations relevant to the representation of nurses in criminal matters. It will also discuss strategies for minimizing the effect of a criminal conviction on a nurse’s license and his or her ability to continue practicing.

Todd Newkirk began his career in administrative law while working for the Ohio Attorney General’s Office. In his capacity as an Assistant Attorney General, he represented several of Ohio’s healthcare licensing boards in disciplinary actions against healthcare professionals. In 2007, he left the Attorney General’s office to work on the defense side of licensure matters. With the depth of knowledge his early career provided regarding the specific laws and compliance regulations that relate to healthcare entities, he later founded Newkirk Health Law, LLC, where he represents healthcare professionals in a variety of matters including contract, corporate and employment law. However, the primary focus of his practice remains the defense of nurses, physicians, pharmacists, veterinarians, dentists, and other healthcare professionals before their respective licensing boards.
