FDA Tobacco Sales Webinar

FDA TOBACCO SALES

The FDA conducts unannounced tobacco inspections and compliance checks at MA tobacco retailers.  The FDA is limited in what they enforce, and although flavor products are banned in MA, this is not a federal law and the FDA does not enforce on the flavor ban or other local policies like blunt wrap bans.  The MHOA tobacco control program monitors the public FDA website and notifies local boards of health if there have been any violations like sale to someone under 21.  There is no local enforcement action recommended, however, a record of FDA violations can be helpful when you do your local enforcement.  The FDA has recently posted a webinar on their database and how to use it:

“Using the ‘Compliance Check Inspections of Brick and Mortar Tobacco Product Retailers’ Database."

This webinar includes information on:

  • Accessing the database
  • Searching the database
  • Finding additional resources
I am available to answer your questions on this, but I don't have access to any information beyond what is viewable on the FDA website.
