Medical Liability: A State-Level Review

 

Due to the OSMA’s efforts to pass comprehensive medical liability reform legislation in the early 2000s, Ohio has had a stable medical malpractice marketplace for more than twenty years.

This has resulted in relatively flat rates and a robust market. This progress has not brought complacency. We continue to be active in state-level litigation related to medical liability and are always keeping a close eye on any legislative efforts to revise our laws.

Unfortunately for the profession, Ohio’s current stability is not found universally across the country. In fact many states have or are experiencing significant challenges. The American Medical Association recently published a comprehensive state-level review of medical malpractice reform, Medical Liability Reform Now! 2025. It covers a variety of issues including caps on damages, ballot initiatives, federal activity, judicial activity and innovative reforms.
