Amicus Brief Filed on Federal PREP Act

June 13, 2022 – OSMA, along with the U.S. Chamber of Commerce and the American Medical Association (AMA), is participating in an amicus brief in the federal Sixth Circuit Court of Appeals on the question of whether the federal Public Readiness and Emergency Preparedness Act (the PREP Act) provides immunity from liability in a wrongful death claim against an assisted living facility for failing to take appropriate countermeasures during the early days of the COVID-19 pandemic.

COVID-19 Vaccine Booster: Communications Toolkit Now Available from ODH

April 5, 2022 – The CDC announced that certain immunocompromised individuals and people over the age of 50 who received an initial booster dose at least 4 months ago are now eligible for another mRNA booster to increase their protection against severe disease from COVID-19. The Ohio Department of Health has created a COVID-19 vaccine booster communications tool kit for physician uses.

Ohio Department of Insurance Activates Surprise Billing Arbitration Portal

March 24, 2022 – In partnership with an outside vendor Maximus Federal, the Ohio Department of Insurance (ODI) has now activated the portal where physicians can arbitrate certain out-of-network payments should they not receive an agreeable reimbursement from the insurer.

Medical Board Recap: Comments on Proposed Rules Due March 1st

February 17, 2022 – At the February 9th meeting, the board approved an initial draft of the telehealth rules that were drafted to support the recently passed telemedicine legislation. The the board also approved an initial draft of a rule that would allow for the prescribing of weight loss medication beyond 12 weeks with provisions that would prevent overprescribing, abuse, and diversion of the medication.

Telehealth Legislation Passes Ohio Legislature

December 16, 2021 – Telehealth rules relaxed by the state Medical Board during the pandemic are becoming permanent. Governor DeWine is expected to sign House Bill 122 into law later this month, and the legislation will become effective 90 days after it is signed.

Legislation Passes to Avert Most Medicare Cuts in 2022

December 15, 2021 – Due in part to the advocacy efforts of OSMA and Ohio physicians and with the leadership of the AMA and national specialty societies, congress passed legislation late last week to avert most of the scheduled Medicare physician cuts scheduled to start on January 1. We are thankful for all the calls and emails from Ohio physicians that helped make a difference, and we thank both Senators Brown and Portman for their votes.

November 3, 2021 - Following the U.S. Food and Drug Administration granting an emergency use authorization to the Pfizer-BioNTech COVID-19 pediatric vaccine formulation, and pending a recommendation from the Centers for Disease Control and Prevention, the Ohio Department of Health is announcing that vaccine providers across the state can begin vaccinating children ages 5 to 11 years old as soon as the CDC makes its recommendation.

MIPS Performance Feedback, Final Scores, & Adjusted Information

August 23, 2021 - CMS recently made us aware that certain MIPS participant scores for 2020 were inadvertently miscalculated due to a technical issue. CMS is recalculating all scores to ensure their accuracy and plans to update both the 2020 scores and related 2022 payment adjustment information in the next few weeks. CMS also informed that the deadline to submit an appeal, or targeted review request, would also be extended.

Open Notes in Healthcare: The Good, the Bad, and the Ugly of the Cures Act

August 2, 2021 - On April 5, 2021, a requirement of the 21st Century Cures Act went into effect: Patients must be able to access information in their EHRs “without delay.” (This requirement does not apply to paper records.) The Cures Act prohibition against information blocking, often referred to as an “open notes” provision, provides patients with transparency in the outcomes of their healthcare via convenient access to information in their EHR, which can positively or negatively impact the patient-doctor relationship.

Ohio to Enter into the Interstate Medical Licensure Compact

July 13, 2021 - Senate Bill 6, signed into law by Governor DeWine on June 29, 2021, authorizes the State Medical Board of Ohio to enter into the Interstate Medical Licensure Compact. Ohio becomes the 35th state to become a member of the Compact. Physicians from any state with Compact membership, including Ohio, who meet the qualifications will be eligible for licensure in any other participating state. Medical Board Recap: Comments on Proposed Rules Due March 1st

February 17, 2022 – At the February 9th meeting, the board approved an initial draft of the telehealth rules that were drafted to support the recently passed telemedicine legislation. The the board also approved an initial draft of a rule that would allow for the prescribing of weight loss medication beyond 12 weeks with provisions that would prevent overprescribing, abuse, and diversion of the medication.

Federal Vaccine Mandates Update – How is your practice impacted?

January 4, 2022 – The US Supreme Court has announced it will hear arguments on Friday, January 7, on whether two separately-issued vaccine mandates may go into effect. One is the CMS mandate that applies to staff working at CMS-certified facilities such as hospitals, and the other is the OSHA vaccine and testing mandate that applies to all employers with more than 100 employees.

Telehealth Legislation Passes Ohio Legislature

December 16, 2021 – Telehealth rules relaxed by the state Medical Board during the pandemic are becoming permanent. Governor DeWine is expected to sign House Bill 122 into law later this month, and the legislation will become effective 90 days after it is signed.

Legislation Passes to Avert Most Medicare Cuts in 2022

December 15, 2021 – Due in part to the advocacy efforts of OSMA and Ohio physicians and with the leadership of the AMA and national specialty societies, congress passed legislation late last week to avert most of the scheduled Medicare physician cuts scheduled to start on January 1. We are thankful for all the calls and emails from Ohio physicians that helped make a difference, and we thank both Senators Brown and Portman for their votes.

November 21, 2021 – The letter asks for revisions to the requirements in the most recent Interim Final Rule (IFR) implementing the No Surprises Act (NSA) that require an Independent Dispute Resolution (IDR) entity to assume the Qualified Payment Amount (QPA) is a reasonable out-of-network rate, unless credible information submitted by the parties clearly demonstrates that the QPA is materially different from the appropriate out-of-network rate.

Open Notes in Healthcare: The Good, the Bad, and the Ugly of the Cures Act

August 2, 2021 - On April 5, 2021, a requirement of the 21st Century Cures Act went into effect: Patients must be able to access information in their EHRs “without delay.” (This requirement does not apply to paper records.) The Cures Act prohibition against information blocking, often referred to as an “open notes” provision, provides patients with transparency in the outcomes of their healthcare via convenient access to information in their EHR, which can positively or negatively impact the patient-doctor relationship.

February 17, 2022 – At the February 9th meeting, the board approved an initial draft of the telehealth rules that were drafted to support the recently passed telemedicine legislation. The the board also approved an initial draft of a rule that would allow for the prescribing of weight loss medication beyond 12 weeks with provisions that would prevent overprescribing, abuse, and diversion of the medication.

Telehealth Legislation Passes Ohio Legislature

December 16, 2021 – Telehealth rules relaxed by the state Medical Board during the pandemic are becoming permanent. Governor DeWine is expected to sign House Bill 122 into law later this month, and the legislation will become effective 90 days after it is signed.

Legislation Passes to Avert Most Medicare Cuts in 2022

December 15, 2021 – Due in part to the advocacy efforts of OSMA and Ohio physicians and with the leadership of the AMA and national specialty societies, congress passed legislation late last week to avert most of the scheduled Medicare physician cuts scheduled to start on January 1. MIPS Performance Feedback, Final Scores, & Adjusted Information

August 23, 2021 - CMS recently made us aware that certain MIPS participant scores for 2020 were inadvertently miscalculated due to a technical issue. CMS is recalculating all scores to ensure their accuracy and plans to update both the 2020 scores and related 2022 payment adjustment information in the next few weeks. Ohio to Enter into the Interstate Medical Licensure Compact

July 13, 2021 - Senate Bill 6, signed into law by Governor DeWine on June 29, 2021, authorizes the State Medical Board of Ohio to enter into the Interstate Medical Licensure Compact. November 18, 2021 - The Ohio Legislature continues to consider House Bill 122. The bill includes provisions that would make many of the telehealth rule changes, which were enacted due to the pandemic, permanent. Also, a new FAQ is now available.

COVID-19 Vaccines Will Soon Be Available to Ohioans Ages 5-11 Years Old

November 3, 2021 - Following the U.S. Food and Drug Administration granting an emergency use authorization to the Pfizer-BioNTech COVID-19 pediatric vaccine formulation, and pending a recommendation from the Centers for Disease Control and Prevention, the Ohio Department of Health is announcing that vaccine providers across the state can begin vaccinating children ages 5 to 11 years old as soon as the CDC makes its recommendation.

Open Notes in Healthcare: The Good, the Bad, and the Ugly of the Cures Act

August 2, 2021 - On April 5, 2021, a requirement of the 21st Century Cures Act went into effect: Patients must be able to access information in their EHRs “without delay.” (This requirement does not apply to paper records.) The Cures Act prohibition against information blocking, often referred to as an “open notes” provision, provides patients with transparency in the outcomes of their healthcare via convenient access to information in their EHR, which can positively or negatively impact the patient-doctor relationship.
