Important Michigan House and Senate Committees and Subcommittees
Most of the legislation affecting chiropractors and their patients in the Michigan Legislature are assigned to the Senate and House Health Policy Committee, Insurance Committee, and/or Appropriations Committees dealing with the budget for the Michigan Department of Health and Human Services, which governs the state’s Medicaid budget. Committees review all legislation that affects their issue area and make recommendations as to whether the full chamber should take up the bills. Committee chairs, such as state Sen. Kevin Hertel and state Rep. Julie Rogers, decide when (and if) bills are heard, run committee meetings, and organize informational hearings to help lawmakers and the public understand important issues.
It is vitally important that we continue to have good working relationships with the committee chairs and members of these important committees in both the House and Senate if we want our legislative agenda to move forward.
Note: Democrats currently hold majorities in both the House and Senate [56-54 in the House, 20-18 in the Senate], so committees are weighted to reflect these majorities.
The Senate and House Health Policy Committees
The House and Senate Health Policy Committees are responsible for deliberating on issues related to public health, health professionals, mental health and wellness, and overall access to healthcare. Legislation dealing with health care is most often (but not always) assigned to these committees. Many of the bills in our legislative agenda will be assigned to these committees.
House Health Policy Committee (12 Democrats/7 Republicans)
Meet Committee Chair Julie Rogers (D-Kalamazoo)
In November 2022, State Rep. Julie M. Rogers was re-elected to her second term in the Michigan House. Her district, the 41st, includes portions of the city of Kalamazoo, city of Portage, and Kalamazoo and Comstock townships. She is a practicing physical therapist and served on the Kalamazoo County Board of Commissioners for eight years.
Aside from her duties as chair of Health Policy, she also serves as a member of the House Committee on Insurance and Financial Services, House Committee on Military, Veterans and Homeland Security, House Appropriations Committee, and House Committee on Local Government and Municipal Finance. Rogers also chairs the Biosciences Legislative Caucus and is the co-chair of the Arts and Culture Legislative Caucus.
Rep. Rogers grew up in Kalamazoo and attended Marquette University, where she earned a master’s degree in physical therapy. Her 23-year career as a physical therapist has led her to become a champion of public health, serving on the National Association of Counties Health Steering Committee for seven years. Rogers’ experience as a physical therapist inspired her to advocate for auto no-fault reform, after seeing the devastating effects that forced catastrophic car accident survivors to lose their long-term care. She has been recognized for her work with a nomination to the Class of 2019 Women in Government, a national nonpartisan leadership program for women elected officials of all levels of government.
Rep. Rogers lives in Kalamazoo, where she enjoys participating in community runs and triathlons. Her past service includes: Girls on the Run coach, West Michigan Cancer Center Board, Hospital Hospitality House Board, Ascension Borgess Diversity Council, Bronson Hospital Patient & Family Advisory Council, Junior League of Kalamazoo member, and team leader for Adopt-A-Highway cleanup program.

In November 2022, state Senator Kevin Hertel was elected to serve his first term in the Michigan Senate. He represents Michigan’s 12th Senate District which includes part of Clinton Township and all of Algonac, Chesterfield Township, Clay Township, Grosse Pointe, Grosse Pointe Farms, Grosse Pointe Park, Grosse Pointe Shores, Grosse Pointe Woods, Harper Woods, Harrison Township, Ira Township, Mount Clemens, New Baltimore, and St. Clair Shores.
He previously served in the Michigan House of Representatives from 2017-2022.
Last session, Sen. Hertel sponsored pro-chiropractic, MAC-developed bipartisan legislation that would allow chiropractors to partner with like-minded MDs/DOs to form a professional corporation together. The bill passed the Michigan Legislature by a combined 135-4 vote and was signed into law by Governor Whitmer last March. Sen. Hertel expertly shepherded the bills through the legislative process and his hard work and dedication were a major factor in their passage.
A graduate of Michigan State University, Sen. Hertel worked for Blue Cross Blue Shield of Michigan as a legislative analyst and then as a special assistant in the office of the president prior to being elected to the House. He is a proud member of his community and is part of the St. Clair Shores Waterfront Environmental Committee, a volunteer for Macomb County Special Olympics and a member of St. Isaac Jogues Parish. He also serves on the Board of Directors for Macomb County Care House.

When a bill or resolution is first introduced in the House of Representatives or the Senate, it is assigned to a committee that deals with its particular issue. At committee meetings, elected members delegated by the House or Senate consider and make recommendations considering dispositions of bills, resolutions, and other matters referred to them. Committees are appointed by the Speaker of the House or the Senate Majority Leader and are organized according to subject matter.
There are currently 22 House and 20 Senate “standing” committees. These committees contain from five to thirty members and are appointed for two-year periods. The Appropriations Committees are divided into subcommittees where bills with monetary implications are assigned for discussion, analysis, and revision before being presented to the full committee for action.
When a bill is referred to a standing committee, the members of that committee have a choice in the actions they may take on any bill:
- Report a bill with a favorable recommendation, or without recommendation
- Report a bill with amendments, with or without recommendation
- Report a substitute bill in place of the original bill
- Report a bill and recommend that it be referred to another committee
- Take no action on a bill (committees are not required to “report out” a bill).
Although one of the chief functions of a committee is to “screen out” undesirable bills, arbitrary refusal of a committee to report out a bill can be remedied by a motion to “discharge the committee from further consideration of the bill.”
As a rule, all standing committee meetings are open to the public. Exceptions are extremely rare. Most committee business is conducted during the meeting and most committee action requires the approval of a majority of those appointed and serving on the committee. If there are a sufficient number of affirmative votes, the bill is reported out and goes to the full chamber for a “yea” or “nay” vote.

Bipartisan Bill to Modernize Chiropractic Coverage in Medicare Re-Introduced in U.S. Senate and House of Representatives
S. 799 / H.R. 1610 Would Allow Chiropractors to Practice to Their State’s Full Scope of Practice, Enabling Medicare Patients to Access Additional Medically Necessary Covered Services

On March 14, 2023, the Chiropractic Coverage Modernization Act (S. 799 / H.R. 1610) was re-introduced in the U.S. House of Representatives. The bill would allow chiropractors in Medicare to practice to their state’s full chiropractic scope of practice, enabling chiropractic patients to safely access medically necessary conservative, drug- and surgery-free care.
Imagine being able to provide your Medicare patients with access to the full complement of the chiropractic profession’s broad-based, non-drug services, including manual manipulation of the spine and extremities, evaluation and management services, diagnostic imaging, and utilization of other non-drug pain management approaches that have become an important strategy in national efforts to stem the epidemic of prescription opioid overuse and abuse.
Last session, the MAC secured seven Michigan co-sponsors in the U.S. House – half the Michigan delegation. Five of those members of Congress – Rep, Jack Bergman, Rep. Debbie Dingell, Rep. Bill Huizenga, Rep. John Moolenaar, and Rep. Tim Walberg – were re-elected to their positions in 2022. Congressman Moolenaar is an original co-sponsor this session, and we are working hard to ensure that all 13 members and Senators Stabenow and Peters sign on to co-sponsor the bill, but we need your help!
Contact Senator Peters, Stabenow, and your U.S. Representative TODAY and ask him or her to co-sponsor S. 799 / H.R. 1610, the Chiropractic Medicare Coverage Modernization Act. Use the MAC Legislative Action Center to send your federal representative an email on this topic. If you live in one district and your office is in another, send an email to both representatives. This is an important first step in the long campaign for full inclusion in Medicare!

More on S. 799 / H.R. 1610 – The Chiropractic Medicare Coverage Modernization Act
There is little doubt that if H.R. 2654 is passed, it would be the most important patient-centered federal chiropractic victory since the profession was first included in Medicare in 1972. Medicare beneficiaries would benefit greatly from having improved access to chiropractic care. Plus, given the enormous influence that Medicare has on both Medicaid and private health insurance, passage of the Chiropractic Medicare Coverage Modernization Act could revolutionize chiropractic’s standing in America’s health care systems.
The current Medicare law is unfair to chiropractic patients and the profession. It also drives the skyrocketing costs of the Medicare system – a system that we as federal taxpayers are funding – by pushing patients into higher risk, higher-cost medical alternatives and away from the use of safe, efficacious, and cost-effective chiropractic care.

Tenth MAC Strategic Planning Session
In February, the MAC Executive Committee, Board of Directors, committee leadership and members, staff, outside consultants, and other interested parties gathered in Lansing to lay the course of our association for the next two years. The MAC’s Strategic Planning Session brought together a tremendous combination of talent, dedication, and experience to set the goals of our organization during my two-year presidency, which began January 1st and runs through December 31, 2024.
After inspirational presentations from MAC Chairwoman of the Board Dr. Lisa Olszewski – our immediate past president – and Board of Directors member (and immediate past Chairman of the Board) Dr. Eric DiMartino, we separated into groups to create our goals in the following areas:

New Michigan Board of Chiropractic Administrative Rules Now In Effect!
Be Aware of the New Rules Governing Continuing Education, Licensure Renewal and Re-Licensure, and Continuing Education Waivers
What You Need to Know
- Physical measures and performance and ordering of tests continuing education hours no longer must be obtained at a live, in-person program. They can now be taken online. The MAC has several webinars that satisfy this requirement (see below). Check out our library here.
- The rule governing continuing education clarifies the period in which a licensee must request a waiver of continuing education (not less than 30 days before the last regularly scheduled board meeting before the expiration date of the license).
- The rules pertaining to application by endorsement and re-licensure were updated to incorporates recent legislative changes that allow reciprocity with Canadian provinces and examinations.
Introduction
On March 29, 2023, an update to the Michigan Board of Chiropractic’s Administrative Rules was filed with the Office of the Great Seal, the final step of the State’s rulemaking process. Many of the new changes are technical in nature, such as cleaning up outdated language, correcting grammatical errors, making typographical revisions, etc. However, some changes – particularly those regarding continuing education and the relicensure process – will directly affect Michigan chiropractors.
What is an Administrative Rule?
An administrative rule is an agency's written regulation, statement, standard, policy, ruling, or instruction that has the effect of law. The general purpose of the Chiropractic Administrative Rules is to provide educational, licensure, and continuing education requirements for Michigan chiropractors.

R 338.12037. License Renewal; Continuing Education (CE Waivers)
The new rule clarifies the time in which a request for a waiver of continuing education must be received by the Michigan Board of Chiropractic (not less than 30 days before the last regularly scheduled board meeting before the expiration date of the license).
The Board of Chiropractic typically meets four times per year – February, May, August, and November. With the new change to “issue date” renewal dates, if there is a possibility you may need a continuing education waiver for your current licensure period, it is imperative that you are familiar with the dates of these meetings and plan ahead! Meetings dates can be found here.
Keep in mind: Waivers can be granted by the Michigan Board of Chiropractic for the following reasons: Disability, military service, absence from the continental U.S., or other circumstance beyond the control of the licensee, which the BOC deems good and sufficient.
R 338.12041. Acceptable Continuing Education (Physical Measures and Tests Credits)
Under the former rule, the State of Michigan required continuing education hours for physical measures and the performance and ordering of tests to be obtained at a live, in-person program. This was part of the scope of practice change that came into effect in 2010.
The new rule eliminates the requirement that these hours be obtained at a live, in-person program. Rather, they can now be obtained online and through other distance learning methods approved under the rules.

R 338.12035. Licensure by endorsement; requirements.
The revised rule pertains to applicants for licensure by endorsement and sets forth requirements associated with the process. Specifically, the rule now incorporates recent legislative changes that allow licensure by endorsement for individuals licensed in another state or a province of Canada. It further allows the examinations conducted by the Canadian Chiropractic Examining Board (CCEB) to function as a substitute for passing Parts I, II, III, and IV of the NBCE examination. Finally, the new rule revises the requirements for verification of licenses held in other jurisdictions.

The revised rule allows proof of licensure in a province of Canada as a pathway to relicensure and revises the requirement of verification of licenses held in other states.

Transitioning Patients to Chiropractic Maintenance Care? Use the ANMR Form

Many chiropractic patients rely on chiropractic maintenance care to prevent recurrences, remain pain-free, and maintain wellness and/or a higher quality of life. Maintenance care reflects a shift in treatment to a preventive approach designed to prevent new episodes and maintain current levels. As practice management consulting and coaching expert Mark Sanna, DC, put it in an article in Chiropractic Economics magazine:
“Acute care has, at its core, the expectation of significant improvement in both subjective and objective symptoms, and that’s according to Medicare… Maintenance care, on the other hand, is a level of care at which we do not expect any type of symptoms to significantly improve; our acute care has achieved its maximum effect, and once we have reached that plateau and patients level off, it is maintained at that particular level… Chiropractors have to learn when patients are showing significant improvement in signs and symptoms and when they have reached that plateau for benefits in acute care. That’s when it is time to move to maintenance care.”
Transitioning From Acute to Maintenance Care: Using the BCBSM ANMR Form
Unfortunately, while maintenance care can be extremely beneficial for patients, there are very few Michigan insurance companies that will actually cover it. These companies sometimes call it “routine” or “Medicare non-covered spinal adjustment” care. No Blue Cross Blue Shield of Michigan policies cover such care. The Blue Cross Advance Notice of Member Responsibility (ANMR) Form should be provided when the patient transitions from medically necessary care to non-medically necessary (active chiropractic to maintenance care).
Please note: The ANMR form can also be provided when the patient has Therapeutic Massage (97124) benefits, but the service is not covered and payable when delegated and performed by an LMT. Please see the accompanying article below for use of the ANMR form in this situation.
Active to Maintenance Care Transition Steps
- New patient (or established patient with a new complaint) comes into the office.
- Active care treatment plan developed. This should include:
- Diagnosis including functional decline in objective measures
- Recommended level of care (duration/frequency of visits)
- Specific treatment goals
- Specific treatment methods (adjustments, exercise, traction, etc.)
- Objective measures to evaluate treatment effectiveness
- Once symptoms remain stable or progress in reducing symptoms is no longer shown, transition patient to maintenance care.
- Discuss further care options with the patient.
- If the patient wishes to continue care, they must pay out of pocket.
- Be sure to have the patient sign the ANMR form before any subsequent care begins.
- Maintenance care plan commences.
Transitioning Back to Active Care
If the patient sustains future injury/loss of function, and his or her condition once again meets the criteria for active care, follow the steps above.

Use of the ANMR Form and Massage Therapy Benefits
As you are no doubt aware, Blue Cross consistently sells health insurance policies that state they provide massage therapy services as part of the patient’s chiropractic benefit, but in fact only provide them when performed by the chiropractic physician him- or herself. This can cause confusion among BCBSM contract holders, especially those who have moved from MESSA, where massage therapy is able to be delegated to a licensed massage therapist, to another Blue Cross product in which it is not.
The MAC has created a handout that members can put on their letterhead and use to explain this situation to their patients with Blue Cross contracts that will not pay chiropractors for delegated massage therapy services. This handout can be used when a new patient comes into the office for the first time, or when an established patient gets new insurance, such as when a MESSA patient changes insurance to a new contract that does not pay for delegated massage therapy services.
- Contact BCBSM Provider Inquiry at (800) 344-8525 to determine whether the patient’s contract allows delegation of MT services or not. BCBSM’s automated interactive voice response system provides benefit information. However, if you can’t get this information through the automated system and you need additional information, transfer to a customer service representative (available during business hours, 8:30am – 5:00pm, Monday through Friday).
- Ask specifically: “Is massage payable under this contract when performed by a licensed massage therapist, and under the direct supervision of a DC?”
- Be sure to then note in the patient’s file that you checked, the date you checked, and the person you talked to.
- If Blue Cross does not pay for delegated massage therapy services, discuss this with the patient. Give them the MAC “Understanding Your Blue Cross Massage Therapy Benefit” handout. Explain that if they wish to receive MT services in your office, they will have to pay for them out-of-pocket moving forward.
- If they agree to pay out of pocket, make sure they sign the BCBSM AMNR form before providing any further care.
New Michigan Law Regarding Prior Authorization Takes Effect June 1st
Process Designed to Be Quicker, More Effective, and Transparent

In April 2022, legislation promising prior authorization (PA) reform was signed into law by Governor Whitmer. The goal of the new law (Public Act 60 of 2022) is making the PA process faster, more effective, and transparent. It includes a standardized electronic prior authorization request transaction process, a requirement that prior authorization requirements be based on peer-reviewed clinical review criteria that meet certain requirements, and expedited review timelines. The new law is fully effective as of June 1, 2023.
It should be noted that in no way does Public Act 60 repeal prior authorization.
Among other provisions, the new law:
- Requires insurers that require a prior authorization with respect to any benefit to make available, by June 1, 2023, a standardized electronic prior authorization request transaction process.
- Requires prior authorization requirements to be based on peer-reviewed clinical review criteria that meet certain requirements.
- Requires insurers to post on their website if they implement a new prior authorization requirement or restriction – or amends an existing requirement or restriction – with respect to any benefit under a health benefit plan.
- Requires an adverse determination regarding a request for a prior authorization for a benefit other than a prescription drug benefit to be made by a licensed physician.
- Requires an insurer or its designee utilization review organization to notify, on issuing a medical benefit denial, the health professional and insured or enrollee of certain information, including the right to appeal the adverse determination, and require an appeal of the denial to be reviewed by a health professional to which certain requirements apply.
- Prohibits an insurer or its designee utilization review organization from affirming the denial of an appeal unless the appeal is reviewed by a licensed physician who meets certain qualifications.
- Prescribes procedures for granting a prior authorization request that has or has not been certified as urgent by a health care provider.
- Requires insurers to adopt a program that promotes the modification of prior authorization requirements of certain prescription drugs, medical care, or related benefits, based on certain factors.
Timeline: Urgent Vs. Non-Urgent Prior Authorization Requests
Under the new law, “urgent” means “an insured or enrollee is suffering from a health condition that may seriously jeopardize the insured’s life, health, or ability to regain maximum function or could subject the insured or enrollee to severe adverse health consequences that cannot be adequately managed without the care or treatment that is the subject of the prior authorization.” Beginning June 1, 2023, and moving forward, these PA requests must be acted upon within 72 hours, or they are considered granted.
For non-urgent prior authorization requests:
- June 1, 2023, through May 1, 2024: Request must be acted upon within nine (9) calendar days. If the insurer fails to act within this time frame, the request is considered granted.
- After May 1, 2024: The time frame shifts to seven (7) calendar days for non-urgent requests.
The decision is good for a minimum of 60 days, or the length of time that’s “clinically appropriate,” whichever is longer.
Please note: If the insurer (or its designated utilization review organization) requests additional information, be sure to provide it as quickly as possible, as the above turnaround times reset and the insurer will be required to make its determination following the receipt of the requested information within the above timelines.
Electronic Submissions
Beginning June 1, 2023, all requests for prior authorization must be submitted electronically, “unless the health professional is unable to use the standard process because of a temporary technological or electrical failure.”
“Peer-Reviewed Clinical Review Criteria”
All PA requirements must be based on “peer-reviewed clinical review criteria” that must do all of the following:
- Take into account the needs of atypical patient populations and diagnoses.
- Reflect community standards of care.
- Ensure quality of care and access to needed health care services.
- Be evidence-based criteria.
- Be publicly available free of charge.
- Be sufficiently flexible to allow deviations from norms when justified on a case-by-case basis.
- Be evaluated and updated, if necessary, at least annually.
Adverse Determinations
For an adverse determination regarding a request for prior authorization for a benefit other
than a prescription drug, the adverse determination must be made by a licensed physician. If the PA request is denied, the insurer must notify the health professional and insured or enrollee of the reasons for the denial and related evidence-based criteria, the right to appeal the adverse determination, instructions on how to file the appeal, and additional documentation necessary to support the appeal.
Appeals must be reviewed by a health professional who does not have a direct stake or any financial interest in the outcome of the appeal, has not been involved in making the adverse determination, and considers all known clinical aspects of the health care services under review (including a review of all pertinent medical records provided to the insurer or designee utilization review organization by the insured or enrollee's health care provider and any relevant records provided to the insurer or designee utilization review organization by a health care facility).
It should be noted that the reviewing health professional can – but is not required to – consider input from a health professional who is licensed in the same profession as the health professional providing the health care service.
Insurers are not allowed to affirm the denial of an appeal “unless the appeal is reviewed by a licensed physician who is board certified or eligible in the same specialty as a health care provider who typically manages the medical condition or disease or provides the health care service.” However, if an insurer or its designee utilization review organization cannot identify a licensed physician who meets the requirements described above without exceeding the applicable time limits imposed under the bill, the insurer or its designee review organization may utilize a licensed physician in a similar general specialty as considered appropriate, as determined by the insurer or its designee utilization review organization.

Meridian Medicaid: New Prior Authorization Requirements Beginning July 1st
Prior Authorization Needed for Chiropractic Services Exceeding 18 Visits or More
Effective July 1, 2023, Meridian Medicaid will require prior authorizations for specific medically necessary chiropractic services (CPT codes 98940, 98941, and 98942) exceeding 18 visits. Prior authorization should be requested before performing any spinal manipulation that exceeds the 18-visit limit.
Please note: The initial 18 visits will not require prior authorization.

COA: Insurance Code Does Not Require Administrative Appeal as a Precondition to Sue Insurance Company Over Utilization Reviews
Published Opinion Holds That Appeals to DIFS Prior to Filing a Lawsuit is Wholly Discretionary

On May 25, 2023, the Michigan Court of Appeals issued a decision in True Care Physical Therapy v. Auto Club Group Insurance Company (COA Docket No. 362094), an auto no-fault case that involved a health care provider who filed suit against an auto insurance company rather than first appeal the insurer’s utilization review determination to the Michigan Department of Insurance and Financial Services (DIFS). According to the COA, Michigan’s revised auto no-fault insurance statute does not require a medical provider to administratively appeal an insurance company's utilization review. Rather, the administrative appeal process is optional, and providers may instead file suit without an appeal to DIFS.
The Initial Case
In the case, a 2018 auto accident victim suffered multiple injuries to her neck, back, and right shoulder and began a period of physical therapy with the plaintiff that lasted approximately two years. In 2021, the defendant stopped paying for treatment, following their utilization review. Defendant’s utilization review concluded that plaintiff’s treatment exceeded the American College of Occupational and Environmental Medicine (ACOEM) guidelines’ recommendations for the frequency and duration of treatment for injuries like the plaintiff’s patient. They then issued an explanation of benefits (EOB) denying plaintiff payment based on its utilization review.
Rather than appeal defendant’s determination to the Michigan Department of Insurance and Financial Services (DIFS), plaintiff filed a complaint in circuit court claiming that the defendant breached its contractual obligation to provide no-fault insurance benefits by refusing to pay for reasonable and necessary medical services that the plaintiff provided to the patient covered by the defendant.
Defendant moved for summary disposition on the basis that Michigan law (MCL 500.3157a) and The Administrative Rule governing utilization review (Rule 500.65) required plaintiff to appeal to DIFS before filing suit.
Plaintiff responded, arguing that it had a valid enforceable assignment of PIP benefits from their patient and that MCL 500.3112 of the no-fault act explicitly granted it the right to pursue a direct cause of action against the insurer in the trial court. An administrative appeal to DIFS was not mandatory, they insisted, and that if it were, that rule would conflict with other provisions of the no-fault act.
Without a hearing, the trial court issued an opinion and order denying the motion for summary disposition, ruling that MCL 500.3112 specifically granted plaintiff a direct and independent statutory cause of action against the defendant, and that the cause of action was without preconditions (they were not required to appeal to DIFS first).
The COA Opinion
A published opinion released Friday, May 26, 2023, written by Judge Noah Hood, joined by Judge Elizabeth Gleicher and Judge Allie Greenleaf Maldonado, affirmed the Oakland Circuit Court's denial of summary disposition filed by the defendant, stating:
"The trial court correctly denied [defendant’s] motion for summary disposition because it had subject-matter jurisdiction over [plaintiff’s] claim. At its core, a utilization review is an 'initial evaluation' of the appropriateness of the level and quality of treatment. The cause of action that the Legislature provided in MCL 500.3112 is not preconditioned on the permissive administrative appeal of that initial evaluation. The plain language of the no-fault act demonstrates that the Legislature intended alternate pathways for determining whether care was appropriate."
In the opinion’s conclusion, the Court writes:
“The trial court concluded that the no-fault act, MCL 500.3101 et seq., did not require True Care to administratively appeal Auto Club’s utilization review through the procedures in MCL 500.3157a and Mich Admin Code, R 500.65. We agree and affirm.”
It is not known at this time if the defendant will appeal the COA ruling to the Michigan Supreme Court, Stay tuned for updates as they become available.
